The Law Suit Against Ringier Nigeria

lekki ikoyi link bridge

The Federal High Court Ikoyi in Lagos state on May 3/2018 had the first hearing of the copyright infringement lawsuit against Samsung Electronics West Africa Limited and Ringier Media Nigeria Limited by Eagle Eye Production Limited.

Eagle Eye Production based in Abuja had accused Samsung Electronics and Ringier Nigeria of using a part of its aerial night view video of the Lekki Ikoyi Link Bridge, that had the title “Lekki Ikoyi Link Bridge at Night”, in its Galaxy Note 8 advert without appropriate permission from Eagle Eye Production.

Samsung claimed they had no prior knowledge of the creative process of the advert, as it outsourced to a company called one Cheil Communications Nigeria Limited. Then Cheil Communications Nigeria claimed to have contracted the job out to Ringier Nigeria.

Mr. Nnamdi Oragwu one of Ringier representatives asked the court to dismiss the case because the Lekki Ikoyi Link Bridge is an Icon of a monument for the public to which Eagle Eye Production Limited has no exclusive rights over and they are not the owner of the bridge.

Akeredolu (SAN) also stated in her response to Ringier’s representatives that Eagle Eye Production Limited has not claimed to own the Lekki Ikoyi Link Bridge or have the exclusive right to film the bridge alone.

Akeredolu (SAN) explained that If I have a special technology to take a picture of the National Theatre at night and I make it look so beautiful and engaging that everybody wants to come and see, I am not saying that I own the National Theatre and I am not also saying that the picture taken of the National Theatre by night is mine also.

“The technology I deployed to take that picture and all of what came out is mine. I own the copyright in that picture. And if anybody wants to use, they owe me a duty to come to me and say, ‘I want to use your picture in my film, I want to use your picture in my album, what will be the cost to use’. That, simply, is the copyright infringement we are ascertaining.”
